If you wish to achieve legal permanent residence or a green card, and are living in the United States, you can start the adjustment of status proceeding. However, if you have left the country or are out of the country currently, in most cases it will be necessary to go through consular processing. This process involves an interview with the United States Embassy or Consulate. At Ollie R. Jefferson, Attorney at Law, we assist clients in obtaining immigrant visas at those interviews and can assist you with issues related to hardship waivers, K-1 visas, K-2 visas, K-3 visas and other immigration matters. It is important to have a clear understanding of your rights and know the proper course of action to achieve your desired results.

When consular processing may be necessary for your case:
If a person is in United States and eligible for adjustment of status, consular processing is not generally available or appropriate. However, if you are outside the United States, you almost certainly have to be interviewed at the consulate to acquire an immigrant visa. We can assist you in obtaining necessary documentation and in helping you prepare for interviews with the Consulate.
Consular processing may be necessary or appropriate if:
- You have lived here illegally for over 180 days and cannot apply for adjustment of status
- You are currently residing outside the U.S. and are seeking a K-1 visa, K-2 visa, K-3 visa
- You are an illegal immigrant facing deportation or have already been removed and seeking a hardship waiver
Protecting your rights from consular processing through naturalization
If you leave the United States, it is more difficult to control your immigration situation. Therefore, it is even more important to work with a skilled attorney who can effectively assert your rights. At the consulate, you are dealing with the Department of State. You may face more delays than if you were seeking adjustment of status. We will take a skilled and informed approach to collect all necessary documentation and seek to streamline your case through consular processing.
